Before communicating any personal data, PowerNotte invites you to carefully read this privacy policy (“Privacy Policy”), as it contains important information on the protection of personal data and the security measures adopted to guarantee confidentiality in full compliance with the Applicable Regulations. Furthermore, this Privacy Policy:
is intended to be provided only for the PowerNotte.com website (“Site”) while it does not apply to other websites that may be consulted via external links;
is intended as Information provided pursuant to art. 13 of the Applicable Regulations to those who interact with the Site;
conforms to Recommendation no. 2/2001 relating to the minimum requirements for online data collection in the European Union, adopted on 17 May 2001 by the Article 29 Working Party.
PowerNotte informs you that the processing of your personal data will be based on the principles of lawfulness, correctness, transparency, limitation of purposes and retention, data minimization, accuracy, integrity and confidentiality. Your personal data will therefore be processed in accordance with the legislative provisions of the Applicable Regulations and the confidentiality obligations provided therein.

1. OWNER
In light of the Applicable Regulations, the data controller of the Site is PowerNotte as defined above, which can be contacted for any information regarding the processing of personal data of PowerNotte, including the list of data processors.

2. PERSONAL DATA SUBJECT TO PROCESSING
“Personal Data” means any information relating to an identified or identifiable natural person with particular reference to an identifier such as the name, an identification number, location data, an online identifier or to one or more characteristic elements of his or her physical, physiological, mental, economic, cultural or social identity.

The Personal Data collected by the Site are the following:

a. Browsing data
The computer systems of the Site collect some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with you, but by its very nature could, through processing and association with data held by third parties, allow you to be identified. These include the IP addresses or domain names of the devices used to connect to the Site, the URI (Uniform Resource Identifier) ​​addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to your operating system and IT environment. With respect to these hypotheses, you act as an independent data controller, assuming all legal obligations and responsibilities. In this sense, you grant the broadest indemnity on this point with respect to any dispute, claim, request for compensation for damage from processing, etc. that may be received by PowerNotte from third parties whose Personal Data have been processed through your use of the Site in violation of the Applicable Regulations.

c. Cookies and similar technologies

3. PURPOSE, LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF THE PROCESSING
The Personal Data that you provide through the Site will be processed by PowerNotte for the following purposes:
a) purposes related to the execution of a contract to which you are a party or to the execution of pre-contractual measures adopted at your request (e.g.: contact request via the Contact form, registration to the ICT Insider service, etc.);
b) purposes of research/statistical analysis on aggregate or anonymous data, therefore without the possibility of identifying the user, aimed at measuring the functioning of the Site, measuring traffic and evaluating usability and interest;
c) purposes related to the fulfillment of a legal obligation to which PowerNotte is subject;
d) purposes necessary to ascertain, exercise or defend a right in court or whenever the judicial authorities exercise their jurisdictional functions;
The legal basis for the processing of Personal Data for the purposes referred to in point a) is the provision of a service or the response to a request that do not require consent pursuant to the Applicable Law. The purpose referred to in point b) does not involve the processing of Personal Data, while the purpose referred to in point d) represents a legitimate processing of Personal Data pursuant to the Applicable Law since, once the Personal Data has been provided, the processing is in fact necessary to fulfill a legal obligation to which PowerNotte is subject.

The provision of your Personal Data for the purposes listed above is optional, but failure to provide them could make it impossible to respond to your request or fulfill a legal obligation to which PowerNotte is subject.

4. RECIPIENTS
Your Personal Data may be shared, for the purposes specified in point 3, with:
1. subjects necessary for the provision of the services offered by the Site, including, for example, sending emails and analyzing the functioning of the Site, who typically act as data controllers for PowerNotte;
2. persons authorized by PowerNotte to process Personal Data who have undertaken to maintain confidentiality or have an adequate legal obligation of confidentiality; (e.g. employees and collaborators of PowerNotte; (a. and b. are collectively “Recipients”);
3. jurisdictional authorities in the exercise of their functions when required by the Applicable Regulations.

5. TRANSFERS
Your Personal Data are not transferred to Recipients located outside the European Economic Area. PowerNotte ensures that the electronic and paper processing of your Personal Data by the Recipients takes place in compliance with the Applicable Regulations. Indeed, transfers are based alternatively on an adequacy decision or on the Standard Model Clauses approved by the European Commission. 6. DATA RETENTION
PowerNotte will process your Personal Data for the time strictly necessary to achieve the purposes indicated in point 3. Without prejudice to the above, PowerNotte will process your Personal Data until the time permitted by Italian law to protect its interests (Art. 2947(1)(3) c.c.). Further information regarding the retention period of Personal Data and the criteria used to determine this period can be requested by writing to the Data Controller.

7. YOUR RIGHTS
Within the limits of the Applicable Regulations, you have the right to ask PowerNotte, at any time, for access to your Personal Data, the rectification or erasure of the same or to oppose their processing, the limitation of processing as well as to obtain in a structured, commonly used and machine-readable format the data concerning you.

Pursuant to the Applicable Regulations, you have in any case the right to lodge a complaint with the a competent supervisory authority (Guarantor for the Protection of Personal Data) if you believe that the processing of your Personal Data is contrary to current legislation.

8. AMENDMENTS
This Privacy Policy is effective from 8 June 2017. PowerNotte reserves the right to modify or simply update its content, in part or completely, also due to changes in the Applicable Regulations. PowerNotte will inform you of such changes as soon as they are introduced and they will be binding as soon as they are published on the Site. PowerNotte therefore invites you to visit this section regularly to take note of the most recent and updated version of the Privacy Policy so that you are always updated on the data collected and the use that PowerNotte makes of it.
